The Trademark Law has a system for rescission of the registration of the trademark where the trademark has not been used in connection with any of the designated goods and/or designated services for three consecutive years or longer (trial for rescission of trademark registration based on non-use ).
Not only in the case where the registered trademark has not been used at all, but also in the case where the registered trademark is deformed and used, it may be determined that the registered trademark is not used.
Also if the registered trademark is used in goods and services which are not considered as the designated goods and/or designated services, it may be determined that the registered trademark is not used, and, furthermore, those goods and services may infringe the right of the third party.
